apparently, in mass.... it isn't technically a "hit and run" unless you are injured or your property is damaged. also apparently, the driver who's aggressive action is the cause of the "hit" would not be charged unless you were injured or if he caused damage. ... even if he didn't stop to find out.

something's wrong with that.

1. a driver with an attitude drives with aggression.
2. driver hits ped or bikey
3. driver flees without checking on victim

my point: whether or not the victim is injured, the driver should be penalized for the extremely unsafe, very potentially damaging action.

I'm not 100% sure on this, but I think an officer can only issue a ticket to something the officer's witnessed.
